These Resources include (but are not limited to) any and all downloadable materials, such as lesson plans and images, from Our Site (“Resources”).

Please read these Terms and Conditions carefully before you start to use Our Site. You should understand that by using Our Site, or any resources listed on it, you agree to be bound by these Terms and Conditions. You should print a copy of these Terms and Conditions for future reference.

1. INFORMATION ABOUT US

1.1 www.learnaboutwarmemorials.org is a site operated by War Memorials Trust (“We” “Us” “Our”). We are registered in England and Wales under Charity Number 1201442 (formerly 1062255) and have Our registered office at 1st Floor, 14 Buckingham Palace Road, London, SW1W 0QP.

2. ACCESSING OUR SITE

2.1 Access to Our Site is permitted on a temporary basis, and We reserve the right to withdraw or amend the service We provide on Our Site without notice. We will not be liable if for any reason Our Site is unavailable at any time or for any period.

2.2 You are responsible for making all arrangements necessary for you to have access to Our Site. You are also responsible for ensuring that all persons who access Our Site through your internet connection are aware of these Terms, and that they comply with them.

3. USING OUR SITE

3.1 Our Site has been designed for use by teachers, education professionals and other adults who work with children and young people, on a regular or occasional basis. 

3.2 Resources available on Our Site may only be used:

 3.2.1 In primary or secondary school classrooms in any part of the world;

 3.2.2 In non-school settings including youth groups, after school clubs, and extra-curricular activities, by adults who work with children and young people,

 3.2.3 At home for educational purposes and in special and adult education settings where their use is deemed appropriate by the user.

3.3 Resources may be adapted and reproduced for use only in accordance with clause 3.2. Under no circumstances may the Resources be sold, copied, reproduced, transmitted, published, displayed, distributed, commercially exploited or any derivative works created by individuals, publishers or any other institution, or used otherwise than in accordance with clause 3.2, or with Our written permission.

4. MATERIAL ON OUR SITE

4.1 We do not provide any guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and Resources found on Our website. We exclude liability for any inaccuracies or errors and any consequences arising from them. We strongly recommend that users of Our Resources check them for suitability for the intended purpose before use.

4.2 On the project Showcase, Our website contains material submitted by third parties. While this material is moderated by Our staff before becoming available on Our website, We exclude liability for any error, omission or inaccuracy in such material.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 All copyright, trademarks and all other intellectual property rights in all material, content or Resources supplied as part of this website shall remain at all times vested in Us.  

5.2 You are permitted to use this material only in accordance with clause 3.2 of these Terms and Conditions.You may not copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material, content and Resources otherwise than in accordance with these Terms and Conditions.

5.3 By uploading or submitting any materials, information and/or Resources to Our Site you agree to assign any and all intellectual property rights you may hold in the said materials, information and/or Resources to Us. Legal ownership shall pass from you to Us as soon as the document is uploaded onto Our Site.

6. RELIANCE ON INFORMATION POSTED

6.1 Commentary and other materials posted on Our Site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to Our Site, or by anyone who may be informed of any of its contents.

7. SITE CHANGES

7.1 We aim to update our site regularly, and may change the content at any time. If the need arises, We may suspend access to Our Site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and We are under no obligation to update such material.

8.1 We process information about you in accordance with Our Privacy Policy. By using Our Site, you consent to such processing and you warrant that all data provided by you is accurate.

9. LINKING TO OUR SITE

9.1 We encourage others to link their site to Our Site, provided you do so in a way that is fair and legal. You must not establish a link from any website that is not owned by you. We reserve the right to withdraw linking permission without notice. If you wish to establish a link We require it does not open within a frame-set of another website.

10. LINKS FROM OUR SITE

10.1 Where Our Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

11. FORCE MAJEURE

11.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of Our obligations under a Contract that is caused by events outside Our reasonable control (“Force Majeure Event”).

11.2 A Force Majeure Event includes (but is not limited to) any act, event, omission or accident beyond Our reasonable control and includes (without limitation) the following: (a) strikes, lock-outs or other industrial action; (b) civil commotion, riot, invasion, terrorist attack or war; (c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; and (d) acts, legislation, regulations or restrictions of any government.

11.3 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and We will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which Our obligations under the Contract may be performed despite the Force Majeure Event.

12. GENERAL

12.1 Applicable laws require that some of the information or communications We send to you should be in writing. When using Our Site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on Our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that We provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

12.2 If any of these Terms and Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such Term or Condition will to that extent be severed from the remaining Terms and Conditions, which will continue to be valid to the fullest extent permitted by law.

12.3 These Terms and Conditions and any document expressly referred to in them represent the entire agreement between us in relation to Our Site and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

12.4 We have the right to revise these Terms and Conditions from time to time.

13. JURISDICTION AND APPLICABLE LAW 

13.1 Contracts for the purchase of Products through Our Site or any claim arising from, or related to, a visit to our site will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England.
